Reporting to the Associate General Counsel for Florida Operations and the Chief Legal Officer, Labor and Employment/Medical Staff, the Staff Attorney will provide legal support on a wide range of areas of healthcare operations for Nemours, particularly for Nemours Children's Hospital, Nemours Specialty Clinics in Florida, and Nemours Primary Care Network in Florida-Children’s Health Alliance, LLC (CHA).
The Staff Attorney generally will work with and at the direction of a more senior attorney, but may work autonomously on selected matters within designated areas. This attorney must be able to interact effectively with all levels of staff and management in connection with matters handled.
The Staff Attorney should have experience with contracts, transactions, regulatory issues involving hospitals, physicians, and other healthcare providers, as well as other legal issues that typically arise in connection with the operation of nonprofit healthcare systems. This attorney must have solid knowledge of health care laws and regulations, including Stark, Anti-Kickback, and other Fraud and Abuse provisions.
Serve as Staff Attorney for Florida Operations including NCH and all Nemours affiliate operations in Florida. Support senior attorneys in handling a broad range of health care, business, and operational legal issues, including preparation and/or review of legal documents.
Respond to legal questions from clinical staff and internal business partners in a timely manner.
Provide internal staff development educational sessions on a variety of legal issues as assigned.
Provide support to risk management and senior attorneys on a variety of medico-legal issues.
Negotiate, draft and review complex legal documents, including professional services agreements, vendor contracts, educational agreements, real estate and leasing contracts and other agreements as may be assigned.
Provide legal advice as assigned regarding compliance with relevant laws and regulations, in particular those involving healthcare providers, including EMTALA, HIPAA, Anti-Kickback, Stark laws and relevant Florida laws and regulations. Collaborate with Compliance department on issues affecting business operations.
Must have familiarity with legal issues involving hospital and health law field, contract law, transactions, regulatory issues involving hospitals, physicians, and other healthcare providers, as well as other legal issues that typically arise in connection with the operation of nonprofit healthcare systems.
Provision of advice requires knowledge of relevant laws and regulations in State of Florida.
Must have ability to succinctly describe legal issues as applied to particular operational contexts in oral and written communications with business partners as well as other attorneys.
Must possess strong analytical ability and oral and written communication skills.
Collaborates with others with skill and diplomacy.
Must demonstrate leadership ability, including ability to self-direct.

JD from accredited law school required
Admitted to practice law in Florida
3-5 years of experience in a corporate setting or private practice required
Experience in healthcare operations and physician contracting/business transactions required
Experience dealing with state and federal regulatory agencies strongly preferred
